Agentito Terms of Service

1. Service description

Agentito is a SaaS platform that enables Latin American SMBs to create, configure, and operate their own AI agent on WhatsApp Business, using the official Meta Cloud API.

By registering, you agree to these Terms of Service ("Terms") and our Privacy Policy. If you disagree with any clause, you may not use the service.

2. Account creation

  • You must provide truthful and up-to-date information.
  • You are responsible for maintaining the confidentiality of your credentials.
  • One account equals one business (legal entity or individual). You may not create accounts on behalf of third parties without authorization.
  • Only one active agent per account is supported in v1.

3. Prohibited uses

The following are expressly prohibited:

  • Sending spam, deceptive, or unsolicited messages.
  • Using the service for activities illegal under Argentine, Brazilian, Mexican, or any other applicable jurisdiction's law.
  • Attempting to circumvent rate limits or Meta WhatsApp Business policies.
  • Collecting personal data from your contacts beyond what is necessary to provide the service.
  • Violating Argentina's Personal Data Protection Law (No. 25,326), Brazil's Lei Geral de Proteção de Dados (LGPD), or the EU GDPR where applicable.

4. Payments and billing

  • The service is billed monthly or annually depending on the chosen plan.
  • Payment may be made via Stripe (international card) or MercadoPago (local LATAM payment methods).
  • ARS prices are subject to exchange rate and may be adjusted with 30 days' notice.
  • No refunds for already-paid periods, except for errors attributable to Agentito.

5. Limitation of liability

Agentito acts as a technical intermediary. We are not responsible for the content of bot conversations or business decisions made by the AI agent. Agentito's total liability is limited to the amounts paid in the last 3 months of subscription.

6. Modifications

We may modify these Terms with 15 days' notice, notifying you by email. Continued use of the service implies acceptance of the new terms.

7. WhatsApp connection: two modes and risk of being banned

To connect your WhatsApp number to Agentito we offer two modes:

(a) Official Meta Cloud API — uses the business API authorized by WhatsApp. Requires becoming a Verified Business in Meta Business + App Review approval (4-6 weeks). No risk of arbitrary banning.

(b) WhatsApp Web via unofficial client (QR scan) — the default mode in v1. You connect by scanning a QR code as if it were another device linked to your WhatsApp. This mode violates the WhatsApp Terms of Service and carries the risk of being banned from your number. WhatsApp may activate automatic protections that suspend or delete your number, without prior notice, especially with high volume, repeated identical messages, or if you receive many spam reports.

By using QR mode you expressly accept this risk of being banned and release us from any liability for the loss of the number, the messages, or the associated contacts. You may migrate to the official mode at any time from Settings → WhatsApp (migration requires completing the Meta business onboarding, which can take several weeks).

8. Dispute resolution

These Terms are governed by the laws of the Argentine Republic. Any dispute shall be submitted to the Ordinary Courts of the Autonomous City of Buenos Aires, unless mandatory law provides otherwise.
